Bylaw 16-2001, which took effect December 10, 2001, is the agreement creating an intermunicipal board (régie intermunicipale) to run the Huntingdon regional rink (Patinoire régionale de Huntingdon). Each municipality's share of costs follows its standardized population.
The parties are the town of Huntingdon, the townships of Dundee, Elgin, Godmanchester and Hinchinbrooke, the parishes of Saint-Anicet, Sainte-Barbe and Saint-Stanislas-de-Kostka, and Ormstown. They rely on articles 468 and following of the Loi sur les cités et villes (L.R.Q., c. C-19) and articles 569 and following of the Code municipal to create a board operating a regional rink serving their populations (preamble, art. 1).
Notice of motion was given November 13, 2001. The bylaw was adopted and in force December 10, 2001.
Capital spending (such as buying and building buildings, and buying land, equipment and accessories) is shared after deducting government grants received, pro rata to each municipality's standardized population (population uniformisée) as published each year in the Gazette officielle (art. 7). Operating costs, such as salaries, heating, electricity, insurance and maintenance, and the board's administration costs follow the same formula (art. 8).
A new member must obtain unanimous consent and accept conditions set out in an annex that every member approves by resolution (art. 9). If the board is dissolved, the municipality that keeps its property pays the others their share, based on what each contributed before the agreement and under article 7. Debts are shared by the article 7 formula (art. 11).
The bylaw sets no rink fees or rules for users. It sets how each member municipality's share of the rink's costs, including Ormstown's, is calculated (art. 7, 8).
